Ymateb i ddyfarniad y tribiwnlys

Rydym yn siomedig iawn i glywed dyfarniad y tribiwnlys fod y BBC i dalu £100,000 y flwyddyn am drwydded i ddarlledu gweithiau ein haelodau.  Ar ôl treulio bron iawn i 6 mlynedd yn ymgyrchu am daliadau tecach mae’n newyddion trist fod y tribiwnlys wedi methu â chydnabod gwerth yr hawliau hyn i’r diwydiant cerddoriaeth Gymraeg.

Mae’n amlwg fod y tribiwnlys wedi trio cadw at y status quo cymaint â phosib yn hytrach na pharchu dymuniadau cyfansoddwyr a chyhoeddwyr Cymreig am dal teg. Calon achos y BBC oedd nad oeddynt am dalu mwy i Eos rhag ofn peryglu’r cytundeb cyfforddus rhyngddyn nhw â PRS lle mae gwerth cerddoriaeth Gymraeg yn cael ei gadw lawr fel rhan o gytundeb ‘bulk-buy’. Mae’r tribiwnlys wedi penderfynu ategu’r berthynas glos honno yn hytrach nag amddiffyn diwydiant cerddoriaeth frodorol Cymru.

Mae hyn yn rhoi cerddorion a chyhoeddwyr Cymreig, heb sôn am ddyfodol Eos, mewn sefyllfa ddifrifol iawn. Byddem yn cynnal cyfarfod cyffredinol arbennig mewn rhai wythnosau; mae angen i ni gymryd barn ein haelodau cyn gallu symud ymlaen.

 

Response to the tribunal decision

We are very disappointed with the Tribunal’s decision to order the BBC to pay £100,000 per annum for the licence to broadcast the works of our members. After spending almost 6 years campaigning for fairer rates for our members, it’s very sad that the Tribunal has failed to recognise the value of these rights to the Welsh music industry.

Its clear that the Tribunal has tried to keep the status quo as much as possible, rather than respecting the wishes of the Welsh composers and publishers for a fair rate.  The BBC’s case centred on their reluctance to pay Eos more, so as to safeguard the comfortable arrangement with the PRS, where the value of Welsh music is kept low as part of a ‘bulk buy’ agreement.  The Tribunal has decided to uphold this arrangement rather than defend Wales’ indigenous music industry.

This puts Welsh composers and publishers, as well as Eos’ future, in a very serious situation. We will be holding an emergency general meeting in a few weeks; we need to hear from our members before moving on.
